If it is a Sessions triable case (e.g., offences such as Section 498A IPC along with Section 307 IPC, Section 306 IPC, etc.) and the JMFC is acting only as a committal court, then The JMFC has no power to discharge the accused on merits. If the offences are triable by the JMFC itself, then the Magistrate can consider discharge (depending on the procedural provisions applicable to the nature of the case and whether it is a warrant case instituted on a police report).

Dear Sir If a case is exclusively triable by the Sessions Court then the Magistrate Court before which it is listed acts only as a committing court under Section 209 CrPC / Section 232 BNSS and has no jurisdiction to consider or decide a discharge application which must be moved only before the Sessions Court under Section 227 CrPC / Section 250 BNSS after committal ​However if the offenses alleged in the chargesheet are triable by a Magistrate of the First Class JMFC then the Magistrate has full authority to hear and decide a discharge application under Section 239 CrPC / Section 262 BNSS prior to framing of charges regardless of the nature of the allegations ​You can highlight discrepancies in witness statements lack of signatures or medical issues as grounds to seek discharge before the appropriate court having jurisdiction to try the matter
