In your case under Section 319 CrPC, “petitioner side enquiry” does not mean a full trial or detailed evidence stage. It simply means the court will now hear your side and check whether there is enough material already on record to call (summon) the other persons as accused. It will just see whether there is strong enough material already available to involve those persons in the case. Since the opposite side has only filed a denial without evidence, that by itself does not matter much at this stage. You should focus in preparing your evidence for now.

In your case under Section 319 CrPC, the stage mentioned as “petitioner side enquiry” has a specific procedural meaning, and it is different from final arguments. Section 319 is invoked when the court is considering whether to summon additional persons as accused based on evidence already emerging during trial. The court cannot act merely on allegations or pleadings—it must rely on evidence recorded in the case. When the court says the matter is posted for “petitioner side enquiry,” it generally means that the court is giving you (the applicant/petitioner) an opportunity to substantiate your 319 application through evidence or by pointing out existing evidence on record. This can happen in two ways: Either you rely on evidence already recorded in the main trial (such as witness depositions), and you demonstrate how that evidence clearly implicates the proposed accused, or the court may permit limited examination/clarification to support the application, depending on how the proceedings have unfolded. So, “enquiry” here does not mean a full trial. It means a focused evidentiary exercise to help the court decide whether there is sufficient material to summon the additional accused. Coming to your confusion—earlier you were addressing arguments on maintainability and merits, and now suddenly the matter is listed for enquiry. This shift usually happens because the court has moved beyond preliminary objections and now wants to assess whether the evidentiary threshold under Section 319 is satisfied. It is important to understand that the standard under Section 319 is quite high. The court must be satisfied that the evidence is strong and cogent, not merely a suspicion or bald allegation. That is why the court is giving you an opportunity to “prove” or demonstrate your case at this stage. The respondents filing a counter with mere denial does not carry much weight unless supported by evidence. The real focus now is on what evidence you can point to or bring on record. Practically, at the next date, you should be prepared to: clearly identify the portions of witness testimony or documents that implicate the proposed accused, explain how their role emerges from the evidence already recorded, and show that the threshold for summoning under Section 319 is met. In summary, “petitioner side enquiry” means the court is now examining the evidentiary basis of your Section 319 application, not just hearing arguments. This is a crucial stage, and your focus should now shift from legal submissions to demonstrating strong evidence on record.

Case adjourned to petitioner side enquiry means that the court hearing has been postponed to a future date to allow the petitioner to present their evidence, witnesses or documentation. The petitioner must present their evidence.

it is not necessary that a reply to an application is a complete with complete evidence. evidence can be adduced at a later stages well. now the judge will here both the parties and decide on the application under section 319 CRPC

Since the accused have filed a counter (even if it is a bald denial), the court has now shifted to hear the petitioner’s response to that counter. “Enquiry” here is procedural, not a fresh investigation. It can include: Oral arguments by the petitioner Clarification on facts already on record Reference to evidence already led during trial (since 319 CrPC relies on evidence already before the court) The court will assess whether sufficient evidence exists on record to summon the proposed accused under Section 319 CrPC.
