In a Sec. 319 CrPC petition, the word “enquiry” here means the Court is hearing and examining the petitioner’s side regarding whether additional persons should be summoned as accused based on the evidence available in the ongoing CC case. Since the respondents/accused have already filed their counter, the matter is now posted for hearing the petitioner’s reply/arguments against that counter. At this stage, the Court does not decide merely on denials made in the counter. The Court mainly looks into the sworn statements, documents, deposition/evidence already recorded during trial, and whether such evidence is strong enough to show involvement of the proposed accused. Therefore, postponement of enquiry only means the hearing on the petitioner’s side has been adjourned to another date and the Sec. 319 CrPC petition is still pending consideration before final orders.
