Defamation suit to file and give the legal notice

Society member writing defamatory messages in society whatsapp group against committee members and I am the secretary

If the statements made by the member are false and harm the reputation of committee members, it may amount to criminal defamation. First you should save all evidence (screenshots, chat backups, etc). You may issue a legal notice to the member calling upon them to stop such messages and give an apology. If they continue to do the same you can file an FIR.

If a society member is posting defamatory messages in a WhatsApp group, you should first preserve evidence by taking screenshots with date and time. Such act amounts to defamation, you can issue a legal notice asking the person to stop and apologize. If it continues, you may file a criminal complaint for defamation. Society bye-laws can also be invoked for misconduct.

draft detail legal notice on which you can claim defamation also go to the police and get a non cognizable report registered and take a copy of it which will be under section of defamation it will be useful in your case so that you can file either civil or criminal defamation, against the society members.

Before filing a case, you usually send a legal notice demanding: Stop defamatory statements Apology Compensation (if applicable)

Send a Legal Notice via an advocate. If he does not cease and desist from sending defamatory messages then proceed to file suit for injunction and parallel can also file a police complaint for defamation.
