Defamation Case On ground Of Falsa Complaint To Police Station

A land agent complaint falselessly against me and my family members in Police station and a criminal suit 107 was drawn against me and my family members, but in late r stage the complaint did not appear in the court for witness after three consecutive summons by the court.In later stage the criminal suit was dropped and the accused were discharged.Now my question is that whether I can file defamation case against him as the complaint was false, if so is there any time boundaries or limit for filing the defamation case and where it should be filed for quick disposal.

yes you can file either civil or criminal or both defamation cases against the complainant. in case of civil defamation it has to be filed before the district judge and in case of criminal defamation the court of CJM will be your appropriate forum. the time limit is one year from the date of cause of action but if sufficient cause is shown it can be condoned.

well the time limit is one year and if there is compensation involved then it's 3 years. so assuming that you have recently got the judgement in your favour you are free to file a defamation suit against the other side
