De-Addiction/Rehibilation Centre Killed My Brother and No help by Poli

Date not mentioning, expect, today mid-night means around 01:40 AM (11/04/2025) I have submitted to my brother into rehabilitation center and today at 9:30 called them how is he, he said okay. after next day 12/04/2025 said he is not good condition we have to give him some medicine to be okay. I asked him if not give then, he said, he will not be sleep. *** Not space to entre more words, after 2 days we found him dead and police not helping me. Not received of post mortem as well.

If your brother has died due to the negligence of the rehab facility you can register an FIR against them, if the police officials are not registering the FIR you can file an application before Magistrate regarding the same, but, all deaths cannot be considered as medical negligence, the onus is on you to prove that the negligence happened and you have to gather evidences like medical records etc. to prove medical negligence. I'm sorry for your loss. You should immediately file a written complaint with the higher police authorities (ACP/DCP) regarding your brother's suspicious death. Also, file an RTI to obtain the post-mortem report and details of any inquiry. You can also approach the State Human Rights Commission or file a writ petition in the High Court seeking an independent investigation and direction to the police to act as per law. Preserve all communication and medical records for evidence.

Hi. If the FIR is not registered then you will have to force the police to get it registered. Also post mortem is a must and you should be given a copy of the same. If the police is not helping out , you must engage an advocate to get the things done or engage an ngo if you can. let me know if you need help

Move to the high court directly for this matter citing high handedness in the administration leading to the death and thereafter the non cooperation of police and no post mortem. Any delay in this will only go against you.
