When we file CRPC 227 .Is there any time frame like before first hearing or summons stage ? Can we also file 227 for parents without quash
Discharge petition under section 227 CrPC can be filed after submissions were made by the accused and the prosecution. Based on such submissions the magistrate will decide on discharge. Depending on police complaint or private complaint the provisions 439 or 445 will apply.
