CrPC 156 (3) registration of FIR and prelimnary enquiry

30-Jul-2023 (In Criminal Law)
My wife's petition was heard at Saket court and magistrate has asked police to file ATR in two months time . Accused had furnished forged will at nclt Lodhi road and I also enclosed copy of pvt document examiner in support of my case .there was complete inaction of police on my complaint .she had submitted written complaint to sho and higher official . What does this mean .. police to conduct prelim enquiry now within shortest possible time and register fir ? Would they come to our house for prelim inquiry or call us at police station . Would they attach our written complaint to fir , get it signed by us and give us a copy . Or is there any choice left with them ?

first you should know the meaning of ATR. ATR means Action Taken Report, so in your case the judge has called for an action taken report from the police meaning thereby that judge has asked the police to submit a report with him on the next date of hearing stating therein what action they have taken on your complaint so far. And yes they might contact you for some inquires or they might not do it. And the question that whether they will register a FIR in the given circumstances my answer will be NO. they will not register it without the direction of the court, because if they wanted to register a FIR they would have done it at the first instance only. Hope this satisfies you.
