criminal revision petition filled in sessions court anf if one defendant doesnt attend court can exparte be filled in criminal case against one defendant by petioner??. Will that affects other defendants

Hello Sir/mam If the accused does not appear in court despite being served with summons, a bailable warrant may be issued. If the accused still does not appear, a non-bailable warrant will be issued. well such criminal petition is to be decided on merits , doesn't get affected on technical grounds, if a defendant is proceeded exparte may be he didn't appear or notice not served. in such a scenario case against other defendants will be considered on merits . qua each party and controversial issues. it's rule of natural justice plus merits of case and evidence.

yes court can move ex-parte against the defendant who is not appearing despite notice. However there is no thing like 'filing exparte'. If the judge deems fir, he can move ex-parte against the defendant.
