26-Jun-2023 (In Criminal Law)
Is it possible to have criminal proceedings of one offense under different Magistrates. One is judicial and other is Sub Division Magistrate. Is that possible judgement of Sub Division Magistrate effect the proceedings of Judicial Magistrate? Further it is possible without Having the Judgement of Sub Division Magistrate file the same case in court.

Dear SDM has very limited powers to entertain any criminal proceedings, it depended on the offence whether it comes under the category of trail by the Judicial magistrate or SDM, one offence can not be trailed in both the courts simultaneously.

Respected Sir/Madam First it is necessary to know that under what obligation /Act and under what section of the said Act/nature of the crime, the said complaint has been filed against you. That part is missing in your query which is necessary for the better advice. So please mention it. Thanks and regards Sachin Sharma, Advocate
