Court not releasing my passport due to false 498A case

Session courts are not giving the dates for hearing, I have to travel and need to complete my project in very urgency ASAP. Can I put a petition on High Court, What if High Court Dismiss my case?

In general, sessions courts will hear cases once every month till the case reaches the trial stage.
Once charges are framed and if you have pleaded not guilty, then the courts will schedule the case to be heard either fortnightly/monthly/daily depending on the nature of charges and Work load prevalent at sessions court.
If you still believe that your cases are unduly delayed on account of non participation of witnesses, public prosecutor etc, you can always file an expedition petition at High court with instructions to complete the hearing within 3/4/5/6 months.

File a writ petition in high court for a direction to the trial court to release your passport in view of your urgency in completing project as the trial has not started yet in your case. The high court may allow your prayer and will direct the trial court to release your passport. However, if the high court dismisses the writ, approach Supreme Court.
