The complainant’s act of filing a knowingly false criminal complaint to pressurize someone in a property dispute can amount to false charge, giving false information, and fabrication of evidence, which are more serious than simple defamation. Therefore, your friend can pursue criminal proceedings for false charge and misuse of the judicial process, rather than relying only on defamation.

In your case, since you have already been discharged by the court, it clearly indicates that the complaint filed against you was either false or lacked sufficient material. You are well within your rights to initiate appropriate legal action against the complainant. Apart from defamation under Section 500 IPC, you have stronger and more effective remedies available. You may consider filing a criminal complaint for false charge under Section 211 IPC, which specifically deals with instituting false criminal proceedings with intent to injure. This is more appropriate in your facts than a simple defamation case. You may also invoke Section 182 IPC (providing false information to a public servant), if applicable based on how the complaint was made, and Section 499/500 IPC for defamation if your reputation has been harmed. Additionally, you can file a civil suit for damages claiming compensation for mental harassment, litigation expenses, and reputational loss caused due to the false case. A very effective and practical step is to first send a legal notice to the complainant calling upon them to withdraw allegations and compensate you, failing which you will initiate both civil and criminal proceedings. This often creates pressure and may lead to settlement. It is advisable to rely on the discharge order as your primary document, as it strongly supports your case that the allegations were baseless. In summary, the best course would be: Proceed under Section 211 IPC (false charge) Consider defamation (Section 500 IPC) as an additional ground Claim damages through civil proceedings Begin with a strong legal notice

File a complaint under IPC 211 + 182 + 500 IPC Simultaneously move an application u/s 340 CrPC before the trial court citing abuse of judicial process Use the discharge order as key evidence of falsity and malafide intent
