Counter Complaint After Chargesheet And Cognizance Taken By Magistrate

In 2020 Sep my uncle filed false allegations on me u/s 354 IPC saying I remove her wife clothes but reality is she was not at the incident place and now after chargesheet is filed 354 IPC is removed saying no such incident happened current stage is the cognizance taken and 353 IPC is removed can now I file counter complaint as I am working in MNC and these charges has impacted me a lot as these charges can remove me from my current job as these are related to women and HR takes serious action against the associate those days were really challenging for me after 354 IPC was filed on me

Hello sir
Please correct me if I'm wrong, so, you were discharged of these charges and cognisance was taken against you for some other offences. Well, in that case I would suggest you do have a case that by filing this case, he has maligned your reputation. You should also file a cross case against them as I'm pursuing a similar case of high stakes. You may consult me though.

Yes...you should immediately approach the police station according to your jurisdiction and register a FIR against the culprits. And if they fail to do the needful then approach the court and file a petition under section 156(3) CrPC for registration of FIR.

if you think it's false case than you go to high court for quashing of FIR and there are Many remidise in law like discharged etcat trail stage so you need focus on evidence. only cross exmine case save your case

Since the charges were filed by your uncle, there must have been the court appearance by you and you can totally deny it during filing of the written statement by your advocate. if you wish to file a counter complaint then it is suggested that kindly ask your advocate to do the same and he will be able to assist you in the action. The charges cannot be removed unless your uncle gives a statement in the court that it was a false allegation and withdraws his complaint
