Cotton mill not paying farmers case pending in court what can we do

05-Jul-2023 (In Criminal Law)
There is a spinning industry which buys cotton from farmers and give it to ginners for milling. Money is dealt to be transferred after the cotton bales have been delivered to the spinning industry but the said money was not been paid. A case has been filed on behalf of all the farmers as CRLMC - Appl.under Sec.482 Cr.P.C. 3271 Of 2015. Court has directed that in the interim no coercive action shall be taken against the petitioners till the next listing. It has been one year since we filed case, from that day,the date has been shifting and we are very frustrated and powerless to do anything

To recover the amount from the cotton industry the farmers can file a recovery suite under order 37 of CPC in the civil court. The initial step is to send the legal notice to the Industry to give the due money to the farmers, if they fail to do so, the farmers can initiate a recovery case in the civil court having jurisdiction to the matter to recover the money from the industry.

Sir, I am not able to understand your question. As you say, a case as been filed by all the farmers as CRLMC 3271 of 2015. But CRLMC s filed by one Pawan Kumar Patodia. As it seems there is a FIR against the said Pawan Kumar Patodia, who has filed the CRLMC and this Hon'b;e Court has directed for no coercive action. Please get in touch and clarify things.
As I understand, the case has been filed by the farmers against Pawan Kumar Patodia. PKP has filed the CRLMC and got a Order of no coercive action.
