Conflict of Interest and Legal Ethics

20-Aug-2023 (In Criminal Law)
A lawyer represented an elderly person in a family property dispute which was resolved by partition. The person died at age 95. The same lawyer is now representing the servant and child of the servant who are claiming the same property with an Adoption Deed, a Will, and a Gift Deed all in favor of the servant's child. Is this lawyer's behavior ethical and proper or conflict of interest? What can be done? Thank you.

A lawyer cannot switch sides in the context of the same property suit. however if none of the opposite parties were being represented by him in the previous dispute, he can represent servant and his child against the present opposite parties.

it is the lawyers prerogative to take the case. Ethically the lawyer is bound to represent the side of the person but there is no law which will restrict him to take up this case even otherwise. it is his wish to represent the case from the side which he thinks will have a proper chance of winning
