Confinement of an adult women by parents.

31-Jul-2023 (In Criminal Law)
Hello sir/ madam, needed your guidance as to what actions can be taken if a 19 year old girl’s family is harrasing/physically abusing her and not letting her leave the house. The women helpline was contacted despite which no action has been taken. How to proceed further and can a injunction/restraining order be occupied?

If the behaviour of her parents are intolerable towards her then she should immediately file a complaint in writing and address it to the police station according to her jurisdiction. And if she wants to go legal then she can always file a petition under section 12 Domestic Violence Act. For more legal assistance I am just a call away.

Hello, though it is an unfortunate incident but socially there are things which are happening in the society which should not be there otherwise. you can file for an injunction in the above-mentioned case and to do that you require to consult the understanding advocate who can take up the matter and convince the court to pass an injunction order

The Protection of Women from Domestic Violence Act, 2005, provides protection and relief to women facing violence within the family. The woman can file a application with the court seeking protection, maintenance and other appropriate orders from the court. should you have any queries feel free to contact me

You can approach the magistrate concerned u/s 97 CrPc to issue search warrants for the person who is illegally confined. As you said the girl is physically abused by her parents she is a major by age so she has every right to take her life decisions independently and she can also file cases against these offences. Hope this helped you
