Compounding of offence where FIR is filed SUO MOTU by police

10-Mar-2023 (In Criminal Law)
Good afternoon respected members, I have a case registered against me under section 420 by POLICE after taking SUO MOTU COGNIZANCE of the matter. I wanted to know can this case be compounded? The case is about online cheating where persons cheated are NOT interested in the case and hence no action has been taken from their side and they are NOT a party to the case. It is a matter of SUO MOTU COGNIZANCE by POLICE. Please let me know if this case can be compounded. Thank you very much for your valuable time and response.

If there is no party in a case then you can always go for plea bargaining under section 265. And the FIR registered can also be quashed in the High Court. For more legal assistance I am just a call away.

In this case, compounding is only possible at the trial based on the discretion of the court.

The right to compounding is not present under S.420.

You may proceed to the High Court if charges framed are incorrect.

This case can only be compounded with the permission of court. If the person who got cheated agree to the same or u can also go for quashing to high court on the basis of compromise or merits …rest we need to read the contents of FIR N chargesheet for better guidance..b in touch
