Compliant against assault NCR filed
24-May-2025 (In Criminal Law)
A person assaulted in metro rail on the eye and lips. The victim defended himself and immediately stopped the culprit from escaping the station. The victim called the police. The police reached the location took both victim and culprit to the police station. S.I asked to give a complaint and the other person also gave counter compliant. Police gave NCR to both victim and culprit. The police informed after collecting CCTV from metro they will file an FIR. Will police register FIR after inquiry?
In this scenario, the police have already taken Non-Cognizable Reports (NCRs) from both parties. After collecting CCTV footage, the police may:
- *Register an FIR*: If the CCTV footage supports the victim's complaint and indicates a cognizable offense, the police may register a First Information Report (FIR) against the culprit.
- *Further Investigation*: The police will likely conduct further investigation, including reviewing the CCTV footage, statements from witnesses, and medical reports (if any).
- *Determine the Nature of the Offense*: Based on the investigation, the police will determine whether the offense is cognizable or non-cognizable. If it's cognizable, an FIR will likely be registered.
The police's decision to register an FIR depends on the evidence collected during the investigation.
Relevant laws:
- *Indian Penal Code (IPC)*: Sections 323, 324, 326, and 352 may apply, depending on the nature and severity of the assault.
- *Criminal Procedure Code (CrPC)*: Sections 154 (FIR) and 155 (NCR) govern the police's procedure for registering complaints.
Would you like more information on the FIR registration process or guidance on navigating the legal proceedings?
Dear Sir,
When NCR is issued to both of you police never file FIR against any of you. However, if you are interested you may approach any Advocate and get file private complaint on the basis of NCR issued to you. Further, file application under RTI provisions to get footage of CCTV installed in Metro Station where incident took place and also get medical certificate if possible.
see to it sometimes they won't file FIR, If they haven't done fiR file a complaint in SP office and go to the magistrate court under private Complaint, under section 223 of the BNSS, if the materials and contents of the complaint attract provisions of the BNS 2023 Magistrate will direct the IO to register an FIR and inquiry into the matter
