Complaint Regarding Misleading & Unsatisfactory Services & Fraud

30-Apr-2025 (In Criminal Law)
I feel cheated by Satkar Wellness-Unit of Pachouli Clinic, sector-45, Gurugram. I was pressured by Ms. Neetu Singh into paying ₹1.5 lakh for packages without doctor consultation. No official printed brochure or pricing guide was provided to me. All details regarding cost and discounts were communicated verbally by Ms. Neetu Singh and no formal structure or comparison of offers was presented. I demand a full refund due to misrepresentation, unsafe practices, Fraud and mental distress.

File a Complaint under the Consumer Protection Act, 2019 You may file a consumer complaint before the District Consumer Disputes Redressal Commission, Gurugram, under Sections 2(6), 2(9), and 35 of the Consumer Protection Act. Your complaint should highlight: Misrepresentation of services Absence of informed consent or written documentation Unfair trade practices Demand for refund and compensation for mental harassment Reliefs You May Claim: Refund of ₹1.5 lakhs Compensation for mental harassment Litigation expenses --- 2. File a Criminal Complaint (FIR or Private Complaint) You may also file a complaint under the following IPC provisions: Section 417/420 IPC – Cheating and dishonestly inducing delivery of property Section 406 IPC – Criminal breach of trust Section 506 IPC – Criminal intimidation (if undue pressure or threats used) Section 120B IPC – Criminal conspiracy (if more staff were involved) You can submit the complaint at the nearest Police Station in Sector-45, Gurugram, or file a private complaint under Section 200 CrPC before the local Magistrate. --- 3. Additional Remedies File a grievance with the Haryana Medical Council if any unqualified or non-registered person was promoting medical packages. Approach the Advertising Standards Council of India (ASCI) if any misleading advertisement is involved. --- Next Steps: Would you like me to draft a legal notice to the clinic or prepare a consumer complaint petition with claim for refund and damages?
