Yes, if your complainant is regarding cognizable offence then you have to file application before Superintendent of police of your district for registration of FIR on the application you had already filed in police station. If even though no action will be taken by the police. then you can file complaint before the court of Judicial Magistrate first class of your area by engaging of counsel.

Yes you can as there is no limitation period in criminal jurisprudence..... but subject to certain conditions.....depends on your complaint and the sections you are seeking to invoke.....secondly it will also depend on when you have got knowledge of the same and whether you have intentionally delayed or not.....so depends upon so many factorswants to discuss further....contact me via Lawrato.....Thanks.

Dear questioner, you should file a complaint in the court. The magistrate has the jurisdiction to entertain such complaint, where police did not register the FIR. Magistrate can give directions to police authorities to take appropriate action.
However you should initiate the proceedings as early as possible. Because it's already late. But still you can do it!

if you have any dispatch number, with regard to the file of complaint with the police station, then you can file the private complaint in the court of concerned judicial magistrate, then the Judicial Msgistrate after recording you evidence summoned the accused person against them you have file the application.
