An application for grant of bail either anticipatory, regular or interim may be moved before a competent court of law having jurisdiction. Full advice can only be rendered only after ascertaining full facts and circumstances of the case.
yes you can apply for bail, but granting of the bail is majorly based on the facts and circumstances of the case. Accused in serious offences like yours, do get bail. It is important to understand the allegations against you in the FIR.
though rape is a very heinous crime, chances of getting bail is low & depend on the facts, record of the case and considerations. U/s 376 of IPC it is not a compoundable offence & law does not permit them to be settled simply at the wish of the parties. But if the accused proves the facts which are in favor of him then he can get the bail by the High Court but the bail may be challenged by prosecution. You may also go for Anticipatory Bail u/s 438 of Crpc but totally depend upon the facts & circumstances proved or disproved and of course on the court. Thank You!
