circumstances do judges of lower courts give interim relief for 376

Lower court judge gave interim relief looking at the proof submitted by the boy in a 376 case even though girl has alleged, unnatural, rape , promise to marry and all. She fabricated the FIR properly so that guy gets all the sections, 376, 377, 417 etc. Though from the evidence it was very clear that relationship is consensual. For example girl said X date forceful rape happened without giving any time in FIR and statement too. Guy has photos of all day till 12 am in the night where they are outside, many credit card transactions done in cafe/restaurants etc. Now girl is not able to change FIR nor statement to fit the time as she knows its fake.

If lower court has given interim relief in section 376 etc in terms of bail then u can’t do anything until boy breaches the condition of bail ! Secondly, you need to hire expert advocate to assist you in the court n get you prepared for cross examination etc and said advocate can also act proxy council with public prosecutor.
