Cheque bounce & phone tapping threat what action can be taken

03-Aug-2023 (In Criminal Law)
My father went missing on Dec 1, 2015. I lodged a missing complaint on Dec 2, 2015. After a few days, it came to my knowledge that he has borrowed money from a neighbor(illegal moneylender) and gave cheques in that context. Now after approximately 7 months, he is threatening us(me, mother & sister) that we are hiding the truth and he has tapped all phone conversation & it has been recorded(via Tapping). He is threatening us sue case for cheating along with the cheque bounce case. What steps should I take ?

Have you received any notice regarding cheque bouncing case? If not, don't worry about his threats. He can not do anything unless and until he file a complaint under section 138 NI Act. As per the limitation enshrined in NI act, he has to file a complaint within 45 from the service of the notice. So in short, if he is threatening you for anything, you can lodge a complaint in concerned police station. The police will do there work and as far as the you are not liable for the act of your father. Revert me. If you receive any notice. All the best.

Hello,
Do not worry, he can not recover your father's liability from you in any illegal manner. File a police complaint regarding the threatenig against the money lander. Tapping can only be done by police that too with court orders.
In case you need support you can call me.
Thanks

Your query does not disclose whether the cheques were issued by your father or not and what kind of transaction was initiated by the money lender. It is illegal to tap phone calls without court orders. For assistance you may contact us for an appointment.

You can file a complaint at your nearest police station about the threats you are receiving, it will also serve as an evidence in future legal cases. Also you can mention in the complaint that the debts your father owe are not in your knowledge.
