I was allegedly charged with ipc 353,188,269,270,271. When i went to buy some medicine for my uncle.Upon denying to give the keys to ITPB soldier my vehicle was taken by the police my name wasn't mentioned in the fir.what should i do?
Among other section, 353 is the most serious one as its non bailable. It appears that you might have resisted the public servant. You don't have to worry as police cannot mechanically arrest you, they will serve you a notice to join investigation, if you join the investigation and reply to the notice duly then you cannot be arrest. Maximum of the Charges imposed are bailable and cognizable.
For quashing petition before the honourable High Court. This will make sure that the FIR registered against you is quashed and no legal proceedings or any arrest should happen to you.
Which means that since it is a cognizable case you can be arrested without warrant, but on applying Bail you will be entitled to Furnish the bail. But, I would like to bring to your notice although your name is not mentioned in the FII are however, it will be filed as unknown person and an investigation since your vehicle has been confiscated by the police personals, the FIR will be modified in your name. The better Recourse for you is to file a 482 quashing petition and get the FIR quashed and subsequently apply for anticipatory bail.
