Charge framed by the Metropolitan Magistrate Court.

I want to know whether, once,the Charge is framed by the Court is it given to the accused immediately( without asking for it ??) or it can delay unless the accused asks for it?? Is it free of cost?? Is it necessary that accused must file an application to get the copy of the Charge framed by the court?? Please enlighten me. Thanking you in anticipation.

Dear Sir,
Copy of charge is part of proceedings, court , there is no provision in CrPC to provide it's copy free of charge like an first information report u/s 154 of CrPC to the accused but accused may get the certified copy of the proceedings.

Framing of charge in criminal court trial begins with framing of charge ,the court reads out to you the facts which constitute the section you are charged with ,you can apply for certified copy of the charge or ur advocate can write down the charge from your case and hand over copy to you.

There is no requirement in the law that a Copy of Charge be supplied to the accused. You need to apply for grant of certified copy upon payment of some charges. The only requirement is that the charge must read over to the accused.
