respondents cannot, at this advanced stage, seek to reopen the proceedings on the plea of non-service of the revised petition without explaining how they could file a detailed counter addressing its contents. Their objection is inconsistent with their own conduct and appears to be an afterthought intended only to delay the disposal of the proceedings.

You may point out that respondents filed a detailed counter and argued the matter, showing knowledge of the revised petition. Request the court to reject this plea as an afterthought and proceed without delay.

To answer your query as the facts stated by you, If the respondents had genuinely not received the revised petition, they could not have filed a detailed counter affidavit dealing with its contents, nor could the petitioner have filed a rejoinder to that counter. Further, the Court's order dated 18/06/2026 records that both sides were heard, with the respondents' arguments heard in part. These circumstances prima facie indicate that the respondents were fully aware of the pleadings. Their present plea appears to be an afterthought intended to delay the proceedings. The petitioner should place the court record, proof of service (if available), the respondents' counter affidavit, and the rejoinder on record and respectfully oppose any request for unnecessary adjournment. The Court may be requested to proceed with the matter on merits, as no prejudice has been caused to the respondents

If the respondents have already filed a detailed counter dealing with the contents of the revised petition and the petitioner has filed a rejoinder thereto, their subsequent plea of non-receipt of the revised petition appears inconsistent with the record. The court docket also reflects that both sides were heard. You may point out these facts and request the court to reject any unnecessary adjournment, unless the respondents can demonstrate actual prejudice caused by non-service. The court will consider the overall conduct of the parties before granting any further opportunity.

it might be the case that the respondents have not received a copy of the petition. supply them a copy of the petition before The honorable Court on the next state of hearing. if there is any previous order in which the supply of copy of petition has been recorded such affect may be brought to the knowledge of the presiding officer
