The procedure is that after the chargesheet is filed charges are framed against the accused. Usually, it takes some time for the matter to come up for trial. This is due to the pendency in our criminal courts. However, if the chargesheet is filed then in that case it is expected that the accused appears on the court date. He can appear in person or he can ask his advocate to file an exemption application. In such cases exemption application is allowed since the personal presence of the accused is not required till the time the trial actually begins. If the accused is not appearing and even his Advocates Are not filing exemption applications, then in that case you can file an application for issuance of non-bailable warrant. Since this is a state case, you will have to file the application through the Public Prosecutor. Once the trial in your case begins, most of the part will be done by the public prosecutor of that court. This is so because yours is a state case.
