Car sold to company but delayed in rc transfer

Question: I sold my car through a well known car buying/selling company , about five months ago and handed over physical possession, and all required transfer documents. However, the ownership transfer is still pending. The company confirmed that the vehicle has been sold to end buyer, but buyer is not appearing for RC transfer. I have already given written intimation to the concerned RTO and local police for record purposes. company is no longer replying my emails. Plz give advise

Since you have already handed over physical possession and all transfer documents and have also given written intimation to the concerned RTO and local police, your primary liability is substantially protected. However, mere intimation is not always sufficient in case of any future misuse of the vehicle. You should immediately send a formal legal notice to the company as well as the end buyer (if details are available), calling upon them to complete the RC transfer within a fixed time. In the notice, clearly mention that they will be solely responsible for any civil or criminal liability arising from the vehicle after the date of sale. Simultaneously, submit Form 29 and Form 30 (if not already acknowledged) and apply for “RC transfer intimation / request for transfer pending due to buyer default” before the RTO, seeking endorsement in records. If the company continues to remain unresponsive, you may file a police complaint for cheating and breach of trust and also initiate legal proceedings for deficiency in service against the company. Till RC transfer is completed, regularly keep proof of follow-ups and communications to safeguard yourself from any future liability.

File consumer complaint case before the consumer forum for compensation and recovery of any amount. The forum will give u damages and non service of the company. File a writ petition for direction to rto for ensuring compliance for RC trqnsfer . The court will give direction in one hearing to to for taking compliance.

do you have any receipt for the same, if you have you don't have to worry a lot but you must even apply for cancellation of the registration number done by the RTO., as if you are not the owner and if anything happens you will only have to face consequences that's why you need to have proper receivings of the intimation you have given to the police station and the RTO please make sure that you have written the company's name and the documents you have received from the mediation company
