Your mother-in-law appears to have committed forgery and fraud by concealing your husband’s death, signing forms (29 and 30), and illegally transferring his car into her name without submitting a Surviving Member Certificate, and then selling it to a third party. The subsequent cancellation of the transfer by the RTO and re-registration in your deceased husband’s name indicates a recognition of the irregularity. However, the fact that the third party is still using the car in your husband’s name adds to the legal complications. To address this, you should immediately lodge a formal complaint with the local police, outlining the fraudulent actions, including the forgery, concealment of your husband's death, and the illegal transfer of property. Attach all supporting documents, such as the RTO cancellation order, proof of your husband’s death, and evidence of the car’s current usage. If the police are reluctant to register an FIR, escalate the matter to higher authorities, such as the Superintendent of Police, or approach the court under Section 156(3) of the CrPC to direct the police to lodge an FIR. Additionally, file a separate complaint with the RTO to ensure no further misuse of the vehicle occurs. Engage a lawyer to explore civil remedies for recovering your husband’s property and ensuring accountability for the forgery.
