can unregistered partner claim be done if the other partner cheats
23-Aug-2023 (In Criminal Law)
Hi, I was a partner with proprietor firm ( unregistered) on mutual trust for over 8 plus years. All these years as and when I would seek to sign of partnership my friend would give various reasons and postponed the signing up the partnership deed.
Now as the company grew from zero to a very comfortable position, my friend just denied my partnership and pushed me out of the company both mentally & physically. He started to say that he has not given any word nor signed any document to say that I was a partner. As a partner I given property as collateral with bank to get fund for the company for 1 Cr. After using this money for business all these years, he denied my partnership. Now threaded me to give this property free of cost to him & else he would not clear the 1Cr OD. The bank started to sent notice to me for legal action for not paying the outstanding. Can anyone help me out to recover my claim.I have no money to pay.If anyone can support to recover my claim can I share the amount
Dear Sir,
Normally the partners of unregistered firm cannot be held liable...However suit can be filed in his individual capacity...A suit cannot be filed against partnership firm you may share more details in person so that you can clear all your doubts...
