23-Dec-2024 (In Criminal Law)
My ex has started demanding me money she gave me willingly 10 years back when we were in a relationship. I’m not in a situation to return money. She gave all the money in cash. For 10 years she didn’t say anything but now suddenly she is feeling she will file a case.

Well, She can file a Civil Case as well as a Criminal Case upon you for Recovery of Money under the concerned provisions of the law. She can get your accounts freezed, by stating to Cyber Cell, that, you have in your account Proceeds of Money Crime, as by blackmailing her, you have fraudulently earned amount from her time to time 10 years back, and now, she wants her amount back and such amount as you have earned via illegal activity, that is by blackmailing you, it becomes proceed of money crime.

Under the Limitation Act, a claim for repayment is time-barred after three years, so her demand after 10 years is likely invalid. Without a written agreement or proof, it’s difficult for her to establish the money as a loan. If she files a case, consult a lawyer to defend on grounds of limitation and lack of evidence.
