Can pleading guilty & payment of fine in Court exempt from jail term

15-Jan-2023 (In Criminal Law)
Hello Sir/Mam I was booked under section 40 (drinking in public place) on evening of 13th Jan this year. I was under the influence of alcohol.. My friend who was also booked misbehaved with the police constable physically. We were let go but the police said that he will call us any time this week and then we have to go to Saket Court. I have 2 questions: If i plead guilty, can there be jail term ? If i plead guilty and only made to pay fine, will it make me a criminal disbarring me from govt services, passport,etc..

plead guilty means you accepted the crime and the same can amounts to conviction by paying fine (as per the court practice) once you plead guilty, it amounts to be convicted. As far as Government service is concern, it depends while it cannot be debarred you from applying the passport

Hi, Regarding your query. As per the relevant law, drinking in public is only attractable with a fine. In this instance you will be let off after payment of the fine. However we have to ensure that you are not dragged along with your friend that you assaulted the police officer. Your record can be clean provided you handle this with caution. Do let me know if you have any clarifications.
