The accused has to approach the High Court by filing: Petition under Section 482 CrPC (inherent powers), or Revision Petition (in some cases), or Petition under Article 226 of the Constitution (rare, exceptional cases) When the High Court may remove the name / quash proceedings The High Court can intervene even after charges are framed if: 1. No prima facie case is made out Even if all allegations are accepted as true, no offence is disclosed. 2. No evidence against the accused Charge-sheet contains no material directly connecting the ac to the offence.

Yes, the High Court can remove names by quashing the chargesheet under Section 482 CrPC (now Section 528 BNSS), even after charges are framed, if the allegations lack merit or abuse the legal process.

Once a charge-sheet is filed, there is no legal provision for directly deleting or removing a person’s name from it. The criminal procedure does not permit such an administrative correction at the High Court level or otherwise. If you are aggrieved by your inclusion in the charge-sheet, the only remedies available are to approach the appropriate court through proper legal proceedings. You may either file a quashing petition before the High Court under Section 482 of the Criminal Procedure Code, seeking quashing of the proceedings insofar as they relate to you, or file a discharge application before the trial court at the appropriate stage. In either case, the court will examine the material placed on record to determine whether any prima facie offence is made out against you. Your name can be removed only if the court is satisfied that you have been falsely or intentionally implicated and that no offence is disclosed against you based on the evidence.

The framing of charges itself is charge on accused. If your charge sheet is filed for quashing in high court then it cannot be removed after framing of charge in Lower Court. The court will commence the trial against and HC may ask you to face the trial.
