Can complainant serve summons?
25-Nov-2024 (In Criminal Law)
Summons can be served via email or text. Can judge under any provision of cr code permit complainant or complainant's advocate to serve summons on defendant via email or text?
Yes, Summons can be served via Email as well as by SMS/Truecaller. You need to produce Digital Evidence Certificate for summons submission to the Respondent via Electronic mode to the complainant for proving to the Hon'ble Judge that Summons was served via electronic or digital mode via text or Email.
Under the CrPC, summons are typically served physically. However, the court can permit service via email or text under its inherent powers (Section 482 CrPC) or in exceptional cases where traditional methods fail. Courts may allow alternative service if the defendant's address is unknown or if prior communication has been acknowledged. Always seek court approval for such service methods.
