Can child claim the property of grandfather if father died

Dear Sir My Sister's husband passed away in Oct.2016 in hospital. She have a baby boy of 3 years. In her husband house, only her father in law. Her mother in law is passes away some years ago. Now she has two married Sister in laws. One living in Delhi and another in Ranchi. My Sister's don't want with living in her father in law. Her father in law having a property, which cost approx 80 lakhs. I want to know the right of her baby boy to secure their future.

Who has purchased the property initially , is it being purchased by your sister's husband or it is purchased by your sister's father in law ? Further Information required to answer your query

All the share of the father of child will bequeath on him. But being a minor he can't take it now but his mother can be a gardian and file a suit.

You havent stated that whether the property of grandfather is self acquired or ancestral. If the property is self acquired then the grand son or grand daughter has no right in the self acquired property of father and if the property is ancestral then he or she would have right in it.

If it is self acquired property of father in law then it would be disposed as as per the wishes of the Father in law further if the father-in-law required the property from his father than this Property would be treated as an ancestral property where she can claim her rights

the right of the baby boy depend upon the nature of the property whether the property is a self acquired property or the ancestral property. if it is a self acquired property of the father in law then the boy have no share neither he can claim till the life of the father in law and if it is a ancestral property then the boy can claim his share through his father.
