As per the passports act a person convicted and sentenced to 2 years or more of imprisonment for an offence involving moral turpitude is not allowed to travel abroad for a period of 5 years from conviction. In addition to that conditions under section 356 criminal procedure code are required to be met.

after sentence awarded to the person in a case is over, he is free to lead a normal life as any other individual would do. He can travel abroad unless and until wanted in some other matter. there is no restriction or prohibition in law which would warrant detention of a person without any order to do it.
