Can A pocso case be made out with these circumstances?
20-Jan-2026 (In Criminal Law)
In 2021, a girl then about 17.5 years old first contacted me on Instagram. She is now above 21 years. She asked for my mobile number and we interacted only through friendly chats and occasional calls. There was no romantic relationship and we never met in person despite her requesting to meet several times. I have recent chat messages and a call recording where I stated that I never came to meet her, to which she replied, “Okay, koi baat nahi.” We also live in different cities
My friend, just by looking at your query, it appears you are not disclosing the complete facts. Moreover, quoting some phrases of what you said or not said or what she replied in return won't suffice for any advocate to give you guidance or advice. You are requested to reveal all about it so that you can be guided properly.
Hi --- we can certainly help you in this regard...contact me in this regard.
Stop all communication now
Do not block aggressively (can trigger complaint)
Gradually disengage or politely close communication
Do not argue, justify, or threaten
Silence is safer than explanations
Prepare a Legal Narrative
Timeline from 2021 till date
Nature of chats (friendly only)
Clear refusal to meet
No inducement, no promise
If Any Threat or Complaint Arises
File a pre-emptive complaint / diary entry (GD) stating:
Fear of false implication
Facts + evidence availability
If Police Calls
Do not give statements casually
Seek anticipatory bail only if FIR is registered (not before)
You have never met her, there was no romantic or sexual relationship, and you have messages/call recording showing refusal to meet, which further weakens any allegation. In absence of sexually explicit chats, images, videos, or inducement with sexual intent, POCSO sections would not sustain.
At most, authorities sometimes examine other laws (e.g., stalking or IT Act) depending on content, but on your facts even those appear unlikely. Preserve all chats and recordings. If any complaint arises, seek legal advice promptly and cooperate, as contemporaneous evidence is in your favour.
You have clearly mentioned that: • The interaction began on social media. • There was no physical meeting at any point. • There was no sexual or romantic relationship. • Conversations were limited to friendly chats and occasional calls. • You have chat messages and call recordings showing that you refused to meet and she accepted it without objection. • You both lived in different cities.
On these facts, offences under POCSO, IPC, or IT Act are not attracted.
For an offence under the POCSO Act, there must be: • Sexual assault, or • Sexual intent such as sexual messages, explicit content, grooming with sexual purpose, or inducement for sexual activity.
Mere friendly conversation, without sexual content and without any physical meeting, does not constitute an offence. Courts have consistently held that absence of sexual intent and absence of physical proximity is crucial.
Similarly, offences such as cheating, sexual harassment, or criminal intimidation are not made out if: • There were no false promises, • No coercion, • No threats, • No obscene or sexually explicit communication.
The fact that you have contemporaneous chats and a call recording where you clearly state that you never met her, and she responds calmly, strongly supports your version and negates any allegation of coercion or misconduct.
As a precaution: • Preserve all chats, call logs, and recordings in original digital form. • Do not delete or edit anything. • Do not initiate further contact. • Do not confront or threaten her in any manner. • If any false complaint is made in future, these materials will be decisive in your favour at the inquiry stage itself.
In short, based on what you have stated, there is no criminal liability arising out of friendly online interaction without sexual intent or physical contact.
If there was only friendly communication, no meeting and no relationship, criminal liability is unlikely. Preserve chats/call records, avoid further contact, do not share personal content, and consult counsel if any threat/complaint arises.
