Can a person charged with POSCO Act and on remand be acquitted ?

A primary school teacher accused of bad touching to his students during class on their private parts and threatening them of failing and restricating from school if they tell about it to anyone. The parents and complained about whole abuse to their child and on witness of 6 girl students in front of magistrate he is sent on 14 days remand jail and booked under ipc section 354. There is a rumour that he would be released soon. So my question is that can an accused booked POSCO act be aquitted on such an act?

When any person who was arrested
, He has right to apply bail during the trial it is solely upon the court to grant bail or not.
As far as conviction or acquittal is concerned it depends upon the evidence.
After commencing the trial the trial court summoned the witness to give evidence and court will record there oral evidence.
If witnesses support the case of the prosecution than the court will have option except to convit the guilty.

मजिस्ट्रेट जमानत देने या ना देने के लिये बाध्य नही है, जमानत पूर्णतः मजिस्ट्रेट के विवेक पर आधारित होता है ।
जबकि दोषमुक्त या निर्दोष साबित करने के लिये ट्रायल में आईं साक्ष्य का विश्लेषण करने के बाद ही मजिस्ट्रेट कोई फैसला देता है ।
आपके अनुसार मजिस्ट्रेट के समक्ष 6 साक्षियों को परीक्षित कराया जा चुका है अगर उन सबने घटना का समर्थन किया है तो उसे जमानत नही मिलनी चाहिये बाकी निर्भर पूर्णतः मजिस्ट्रेट के विवेक पर ही है ।

Now once the FIR is registered the investigation will begin and the police will gather the evidence and other proof. If they find a case made out against the person accused they will file a chargesheet and trial will begin. only after the trial can one say if someone will be acquitted or convicted. There is also a possibility that the Police may not find that the case is made out in that scenario they will file a final report and then the magistrate may close the case or take cognizance on his own.
