If no sodomy is committed, no question of Section 377 being applied. Section 377 in the proposed New Bharatiya Nayay Sanhita is otherwise gone also. Even currently, it stands decriminised, since 2018 by an order of Supreme Court. Dr Ajay Kummar Pandey Advocate Supreme Court of India
