Brothers ex wife blackmailing him of false rape case what can he do

14-Jun-2023 (In Criminal Law)
2 years ago she blackmailed my brother to marry her otherwise she will file a rape case. After marriage she harassed my brother and my family, and 1 year later she filed false dowry and rape case. We settled outside the court for divorce for 13 lakhs and some conditions. All the while she was harassing my brother on text messages. After the divorce she didn't stop messaging and begged to meet him one last time. He met her thinking she is regretting. But when he told her to move on she again started making threats for false rape case and even forged a preganancy report. What shall we do?

In this particular matter first and foremost should be a Police Complaint which in such circumstances is not entertained. You would need to get an order by the court U/S 156(3) of CrPC and then proceed. There are a few more options that you can resort to, we can discuss the same in person . Thank you for writing.

Sir if she is blackmailing your brother then you should report it to the concerned police station.. If u r in a suspicion dat police report can be lodged against you then you should apply for interim anticipatory bail

In matters like this it is best if they can be somehow resolved within the family and things do not come out. However if there is such chance of settling then one must approach the judicial and the police authorities. It is rather sad that in your case even after getting a divorce there is no peace of mind and battle is continuing. You could take recourse to both civil and criminal action. If you have to then You must report the matter to the police and get an FIR registered against the girl for harassment and threatening to falsely implicate you in a crime and also for forgery, etc. Initial action by you will ensure you having a upper hand in litigation that may ensue for long. You must brace yourself for it.
