Can i file APPLICATION UNDER SECTION 468(2)(c) in MM/JMFC court or shall i go in session court to disposes of the F.I.R in which last incident was 4 year before and final report is not yet filed (charge sheet) by the police

Thee limitation period to file an application for offenses punishable by up to 7 years is 3 years. Since the FIR is from 4 years ago, the limitation may have lapsed. You can, however, approach the Magistrate Court (MM/JMFC) to request disposal of the case due to the delay in the police filing the final report. If there are valid reasons for the delay, the court may condone it. Alternatively, you can consider approaching the Sessions Court for faster resolution.

The FIR can only be quashed by the High Court. And in that quashing petition you need to attach the certified copy of all the documents along with its true typed and true translated copy. For more legal assistance I am just a call away.

section 468 provide for the bar of taking cognizance you can file perticular application before the court of competent jurisdiction that is Court where case is traible under perticular section only that Court is competent to decide the case.

Session court does not have power to dispose the FIR. It is the inherent power vested with the Honble high court under section 482 crpc. Approach the High court for quashing and also you can seek compensation for such harassment you have suffered seeking damages for malicious prosecution.
