Anticipatory Bail under change of circumstances

26-Nov-2023 (In Criminal Law)
Hello My anticipatory bail has been rejected by sessions court. I have applied in high court. In case the same is rejected by high court, can I apply again for anticipatory bail in session court under change of circumstances?? The IPC applied are 467/468. What are the other options available for me ?? In case of rejection from high court, can the change of circumstances application be done in sessions court or it should be done in high court only.

The law for grant of anticipatory bail is something that the court exercises in extra ordinary cases. If rejected by the sessions and high court then you may go to supreme court. if you want to approach sessions amor HC again then it requires substantial change in circumstances that has direct impact on the case and therefore generally change in circumstances are rarely applicable in anticipatory bail than in regular bail.

To see if the circumstances have changed, we have to look at the order passed by the sessions court rejecting your bail application. we will also have to look at the grounds on which the bail was rejected by the sessions court. The case papers of your case have to be looked into. For Further assistance kindly get in touch with me through lawrato. Regards, Adv. Shrikant Bagade.

Better, you should knock the doors of Supreme Court if High Court rejects your Anticipatory Bail. In case, if Supreme Court rejects your Anticipatory Bail, then you have to surrender before the Court or Police & Police will then seek your Policy Custody for Interrogation. I can help you to seek Anticipatory Bail from Supreme Court.
