Anticipatory Bail from 308,498

I want bail against IPC 308,498 but my lawyer is telling me that police isn't submitted FIR in court so I can't do anything

You have the right to file Anticipatory Bail Application if FIR is lodged although police has not yet submitted it to the concerned court. It is a non bailable offence and therefore if you want to go for Anticipatory Bail, you can go for it. For the same, you can approach me.

you can still file for a bail in that matter . because the provisions available under section 438 of CRPC R in case of non bailable offences only and you have a presumption that you are an accused in that case you can still file for anticipatory bail

You can file anticipatory bail application for protection from the arrest before the session judge court. In response to that state will file there submission whether they have registered FIR or not in case they have registered FIR then you push for bail order otherwise pray to court for pre intimation of the FIR in case it will be lodge by police so that can you move before session court for interim protection in this
matter.
