31-Jan-2026 (In Criminal Law)
FIR was filed against me for theft under the section of 305BNS and they recovered all the items i was arrested but got the bail. I know the complainant personally, because husband of the complainant tried to rape my friend who was working for them in the house. Now I requested them to withdraw the case and the complainant agreed now my question is will I get the government to job if the case is dropped or got acquitted, I am appearing for CGLE so plz tell, also can criminal record get removed.

An FIR under Section 305 BNS (theft) is non-compoundable, so it cannot be withdrawn merely on the complainant’s request; however, since the matter is settled and property has been recovered, the correct legal course is to file a quashing petition before the High Court under Section 528 BNSS, and courts routinely quash such cases. Once quashed or if you are honourably acquitted, you are not treated as a convict, and government employment, including CGLE, is not barred, provided you truthfully disclose the case and submit the court order during verification. Mere registration or pendency of an FIR does not automatically disqualify a candidate. While FIR records are not automatically deleted, after quashing or acquittal you can seek correction of police records and a “no adverse antecedents” certificate. The allegation of retaliation further strengthens your quashing case. Proper legal handling will safeguard your career and reputation.

If the case is closed through court and you are not convicted, your chances of getting a government job remain open, subject to truthful disclosure and nature of final court order. If you want, tell me the exact section mentioned in FIR and stage of case (charge sheet filed or not), I can guide you on the precise legal route. You can contact me for legal advice Regards Adv. If both parties file a compromise statement before the court, the case can be closed or compounded. If the case has already reached the court stage, then your lawyer may file a petition for quashing before the Hon’ble High Court under Section 482 CrPC based on the written compromise. After the case is quashed or you are acquitted, no criminal record remains, and you can legally apply for government jobs like CGLE.

Option A: Compounding of offence If the section applied is compoundable, the complainant can give consent before the court, and the court can close the case. But not all theft-related offences are compoundable, especially if the value is high or aggravating factors exist. ✅ Option B: Quashing in High Court If settlement has happened and dispute was personal in nature, you can file a petition for quashing of FIR in the High Court under Section 482 CrPC (now corresponding provision under BNS procedure). Court may quash if:FIR is quashed by High Court It is treated as if the case never proceeded. This is your best outcome.
