After AnticipatoryBail, What should be done if NO arrest is made

11-Sep-2023 (In Criminal Law)

I have taken Anticipatory bail for a cyber crime case. The court order is as below 2) In the event of arrest of the Applicant, then he be released on executing his PR and SB of Rs 15,000/- on following conditions: (A) Applicant should attend the concerned police station once a week and he should co-operate the IO. (B) He should not pressurise, threaten or tamper the prosecution witness The key clarification that I need is, in case of NO arrest, should I still attend PS every week and later get relaxation through court? or I can stop attending PS after recording my statement.

no you can violate any of the conditions of the ABA on your own.

IF yo want any relaxation in the conditions then you will have to approach the same Court which granted you ABA for modifying and relaxing the conditions of the Bail.

If you stop abiding by the conditions without permission of the Court, then your ABA can be cancelled, so take precaution !

you can file an application to the Sessions Court fro modification of the order passed in the anticipatory bail and can get the order modified and thereby can get relaxation in respect of the weekly attendance in police station.
