Advice in case name mentioned in suicide note by Neighbor.

One lady in my building committed suicide and put my name on suicide note. She bit my 10 year old son in June of this year and one man tried to stop her she hit that man also. After that I don't allowed my son to play with her son.later she keep on requesting to allow my son to play with her son.I said I can't but still she keep on torturing me to allow my son to play with her son.now what I must do.What should be my action if police come

The fact that your name is mentioned in the suicide note makes it ver probable that your name will be included as an accused either in the FIR or the charge-sheet. You may get a summons or notice from the local police station. On getting that intimation immediately apply for anticipatory bail/pre-arrest bail before the Sessions Court to avoid arrest.

Subsequently, the investigation will go on and a charge-sheet may be filed against your name. Post which, there will be a trial before the sessions court.

There are other remedies also available like approaching the High Court for quashing of the FIR, applying for discharge post the charge-sheet is filed, etc.

My opinion is based on the limited set of facts that you have provided.

It's non bailable offence be cautious if once arrested it will be difficult to get bail. Only name in suicide note is not sufficient to book you for abetment of sucide but your torturous act should be there due to which the said lady compelled to committed sucide. Go to court for anticipatory bail and then only to police after getting it.

Speak out the truth to the Police. Don't worry. Don't try to show your apprehension in front of the Investigation team. Be comfortable and narrate them the facts as they are. Nothing will happen to you.
