Advice for person charged under section 374 IPC
24-May-2023 (In Criminal Law)
if person having charge 374 than high court can give bail or not even the evidence also be have?
Offence under Section 374 of Indian Penal Code, as i understand, is a bailable offence and a person can get bail from the concerned police station on furnishing surety and bail bond. Therefore, one may not be required to approach the Court for obtaining bail.
It depends upon the circumstances of the case, but prima facie it is mater on which bail can easily be taken, but still it depends ypon the stage of the trial. So it would be better if you can eloborate the facts of the cases for my batter understanding. Thank you
section 374 ipc deals with forcing compulsory unlawful labour from a person .the offence carries a maximum jail sentence of one year ..the high court in exercise of its extraordinary powers under section 439 ipc has the power to grant bail in the above offence
