The determination of “obscenity” is subjective and depends on prevailing community standards, with courts in recent years adopting a more liberal interpretation in matters of sexual wellness. While personal possession generally poses minimal legal risk, sellers should exercise caution by marketing products as “adult novelty” or “sexual wellness” items, avoiding obscene packaging or advertisements, and ensuring compliance with e-commerce, labelling, and consumer protection norms to minimise exposure to legal challenges.

There is no special law in India which prohibits or allows the selling of sex toys in India but the sale, display, and advertisement of sex toys can be restricted if they are considered obscene and against the Indian law So there is no ban of purchasing and using of sex toys in India
