30-Nov-2024 (In Criminal Law)
During scrutiny of a Acquittal Appeal (Complainant) registry of Hon'ble High Court of Jharkhand has identified a defect that "the Alleged section in which Respondents were acquitted is neither appearing in concluding para of of the Imp. judgment nor in para 1 of the Memo of Appeal." Can this defect can be sufficient to set aside the Imp. Judgement and revert the case for evidence/fresh Judgement to the trial Court.
