you should first send him a legal notice and once that requirement is done you can file a police complaint if he still doesn't give you your money back and you can also use that legal notice as evidence that you have already demanded the money.

give him a legal notice and add criminal charges in the notice and send the copy of the legal notice to the police station as well, if he pays then good if he is not paying then try filing a criminal complaint for the case of fraud, criminal breach of trust and threat.

You have a good case as you already possess WhatsApp chats, call recordings and emails showing admission of liability. First step is to issue a legal notice for recovery of money through an advocate, clearly mentioning amount, date of transaction, proof and giving 7–15 days time to repay. If the person fails to pay after notice, you can file: 1. Civil Suit for Recovery (within 3 years limitation from cause of action), or 2. Summary Suit under Order 37 CPC if there is clear written admission, or 3. Criminal complaint for cheating (IPC 420) if intention was dishonest from beginning. Preserve all electronic evidence properly. Also take printouts with certificate under Section 65B Evidence Act for admissibility. Sending legal notice often results in settlement. If not, proceed with recovery suit for faster relief.

You may issue a legal notice demanding refund with all proof like chats, emails, recordings and payment proof. If unpaid, file civil recovery suit and if cheating/fraud involved, lodge police complaint.

WhatsApp messages and call recordings constitute digital evidence and may play a crucial role at the stage of evidence. However, at this stage, establishing a clear chronology of events is of primary importance. Further, apart from WhatsApp chats and call recordings, it is necessary to ascertain whether you possess any other supporting documents. In such circumstances, the appropriate course of action would generally be to issue a legal recovery notice; however, without a complete understanding of the facts, it is not possible to determine the most suitable course of action.
